India to Re-thinks joining Hague child custody pact.

India will re-think joining the Hague child custody pact, which was signed by many countries. India has announced last year that it will not sign the convention and now it re-thinks its stand of joining and discussing the effects of joining the convention.

About Hague Abduction Convention: 
  • It is an International treaty on Child abduction and makes swift return of children wrongfully retained or removed from their habitual residence from one member country to another country.
  • The Main purpose of the convention is to protect children from wrongful international abduction by parents.
  • The convention is applicable for children under age 16 and 97 countries have been signed till now.

India’s Concern: 
  • Many Indian Women married to Indians settled in foreign countries and they were compelled to return India with their children after violence or conflict with their partners.
  • If India Ratify or signed The Hague Convention on the Civil Aspects of International Child Abduction (1980), which will make women to fly back to the foreign country for settlement of custody.
  • Also India should recognise the foreign judgment automatically irrespective of country’s own law on this issue.
